PubPulse Affiliate Programme Terms

These terms govern the PubPulse affiliate programme (the “Programme”). They form an agreement between Enorme Limited (registered in England and Wales, company number 14608315, registered office Market House, Church Street, Harleston, Norfolk, IP20 9BB), which trades as PubPulse (“we”, “us”, “our”), and you, the person or business taking part (“you”, the “Affiliate”).
By signing up to the Programme through our affiliate portal at pubpulse.getrewardful.com, you agree to these terms. If you do not agree, please do not join.
1. Your status
You take part as an independent contractor. Nothing in these terms makes you our employee, agent or partner, and you have no authority to make promises or enter into agreements on our behalf.
You are responsible for your own tax and National Insurance on any commission we pay you.
All commission is inclusive of VAT. We do not pay VAT in addition to commission, so if you are registered for VAT, the commission we pay includes any VAT you are required to account for.
2. Joining and your account
Your affiliate account, referral link and earnings are managed through our affiliate portal, which is provided for us by Rewardful. You must give accurate details, including the PayPal or Wise account you want to be paid into, and keep them up to date.
We may decline, suspend or close any affiliate account at our discretion.
If we have agreed separate written terms with you, for example as a trade partner, those terms apply where they differ from these.
3. Commission
You earn commission of 20% of the subscription revenue we actually receive, excluding VAT, from customers you refer.
Commission is earned on each PubPulse application a referred customer subscribes to, for up to 12 months from the first paid invoice for that application. An application the customer adds later earns commission for up to 12 months from its own first paid invoice.
No commission is earned on:
- free trials, or any period for which the customer is not charged;
- payments that are refunded, reversed or disputed;
- complimentary or discounted accounts we provide free of charge; or
- VAT or any other tax.
Where a payment you have earned commission on is later refunded or charged back, we will deduct the corresponding commission from your pending or future commission.
4. Referrals and tracking
A referral is counted when a customer who is new to PubPulse creates a PubPulse account after following your referral link, and then pays for a subscription. Referrals are tracked by Rewardful using a cookie that lasts 90 days from the first click. Where a customer has followed more than one affiliate's link, the first link followed is the one credited.
Customers who already have a PubPulse account cannot be referred.
Our tracking records are final. If a customer you introduced signs up without using your link, we may credit you by hand at our discretion, but only if you told us about the introduction in writing before the customer signed up.
5. Payment
Commission becomes payable 30 days after we receive the payment it is earned on. We pay monthly, in pounds sterling, by PayPal or Wise to the account in your affiliate profile, once your payable balance reaches £50. A smaller balance carries forward to the next payment.
We may hold payment while we investigate any suspected breach of these terms, fraud or abuse of the Programme.
6. What you may not do
When promoting PubPulse you must not:
- refer yourself, your own pubs, or any business you own or control;
- bid on “PubPulse”, “PricePulse”, “RotaPulse”, “TaskPulse”, “DiaryPulse” or any similar term as a search keyword, or use those names in advert copy or in a domain name;
- send unsolicited emails, text messages or other electronic marketing promoting PubPulse. You are responsible for complying with the Privacy and Electronic Communications Regulations and data protection law in anything you send;
- make claims about PubPulse or its products that we have not published ourselves;
- present yourself as PubPulse, or as our employee or representative;
- offer discounts, cashback or other incentives we have not authorised; or
- list PubPulse on coupon, voucher or cashback websites without our written consent.
Where you promote PubPulse, you must make clear that you may earn a commission, as UK advertising rules require.
7. Using our name and brand
While you are part of the Programme, we give you a limited, non-exclusive, revocable licence to use the PubPulse name, logos and the promotional materials we supply, only to promote PubPulse under these terms. You must not alter them. The licence ends when your participation ends.
8. Ending your participation
Either of us may end your participation at any time by giving notice. We may end it immediately if you breach these terms.
When your participation ends, commission stops accruing. Commission you have already earned is paid at the next monthly payment, even if your balance is below £50.
If your participation ends because you breached these terms, any commission earned through that breach is forfeited.
9. Changes to these terms
We may change these terms, including the commission rate, by giving you at least 30 days' notice. Changes apply to referrals made after they take effect, unless the law requires otherwise.
10. Liability
Commission under these terms is your only remedy in connection with the Programme. We are not liable for referrals that are not tracked because of a technical failure beyond making a reasonable correction once it is brought to our attention.
Nothing in these terms limits any liability that cannot be limited by law.
11. Personal information
We use the details you give us to run the Programme and pay you, as described in our Privacy Policy.
Your affiliate dashboard shows each customer you have referred only as an anonymous reference, together with the commission it has earned. It does not show their name or email address, and we do not share the personal details of the customers you refer.
12. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them.
